Oso, I tip my hat to you, you have a very good grasp of patent law.
I have worked for an inventor, for over 23 years.
I have watched the patent process at work. I have also noticed that patents and the patenting seem to be a fickle business. The court system shows a jury, supposedly of your peers, an item that
most common people with no technical knowledge try to make a correct and fair judgment. It becomes very difficult for them not being engineers to discern the fine line of improvements or innovations. Therefore many times people lose the huge investment
of researching and developing something new, all due to the lack of technical knowledge of a jury.

The real scary thing actually happens at the patent office. I worked with a fellow engineer that put a few years in as a patent researcher at the patent office in D.C.. Its pure luck to get the patent researchers to approve simple patent pending. He told me many stories.
